Online filing of International Patent Applications is now possible in India.

Recently, the Indian patent office (IPO) launched the electronic patent filing (E-filing) services for Patents. The comprehensive e-filing for Patents via the user interfaces provides online filing of new international patent applications. However, the user has to register his details on the website and require digital signature to sign the patent documents electronically. Therefore it is not possible for foreign applicants to get a digital signature in India. Steps for Online Patent Registration

  1. User Login facility.
  2. Select from two options: quick filing form link or main filing link.
  3. Enter the patent application details.
  4. Save the entered patent details.
  5. Digitally sign the draft patent application via Class III digital signature.
  6. Select the payment method.
  7. Issue of Acknowledgement slip which is generated automatically.
  8. Permanent patent application number / reference numbers generated after 2 working days. 

User Login facility: 

User can login via the online e-filing patent home page. User has to register for logging in the online patent filing database. Already registered user can log in the online patent e-filing interface using the User ID and Password or Class III Digital signature.

Who can register online for patent e-filing in India?

For online filing of patent the user can register in following ways:

  • By a patent Applicant (Natural Person),
  • A Patent Agent,
  •  Authorized representative of a legal entity (ONP) &
  • Authorized representative of a Small entity (SE)

Recently, many patents are filed to inventions which relates to electronic and communication domain. In the technology field of COMMUNICATION, the Indian patent office (IPO) recently granted  patent for an invention titled AUDIO CODEC POST-FILTER to Microsoft. The granted Indian patent relates to techniques and tools for processing reconstructed audio signals. For example, a reconstructed audio signal is filtered in the time domain using filter coefficients that are calculated, at least in part, in the frequency domain. As another example, producing a set of filter coefficients for filtering a reconstructed audio signal includes clipping one or more peaks of a set of coefficient values. As yet another example, for a sub-band codec, in a frequency region near an intersection between two sub-bands, a reconstructed composite signal is enhanced.

This patent invention has been issued granted patent number as 274037 which was filed as patent application number 5400/CHENP/2007 before Chennai patent office. The patent has been classified as G10L21/00 under international patent classification (IPC).  The patent classification G10L21/00 relates to Processing of the speech or voice signal to produce another audible or non-audible signal, e.g. visual or tactile, in order to modify its quality or its intelligibility. The main IPC G10L relates to SPEECH ANALYSIS OR SYNTHESIS; SPEECH RECOGNITION; SPEECH OR VOICE PROCESSING; SPEECH OR AUDIO CODING OR DECODING  In the identified patent classification G10L21/00 total number of patents filed in India are 58 which is quite low as compared other technologies for which patent are filed before the patent office. Till date ten (10) inventions have been granted patent and 48 are still pending patent examination stage before the Indian patent office. The main IPC H03M relates to CODING, DECODING OR CODE CONVERSION, IN GENERAL. In the identified patent classification IPC H03M07/00, total number of patents filed in India are twelve out of which two have been granted and nine are pending patent examination stage before the Indian patent office. Again not much research is happening in coding and decoding across the globe.
